Age of Superannuation Ordinance date 31.01.2022

AN ORDINANCE FURTHER TO AMEND THE ANDHRA PRADESH PUBLIC EMPLOYMENT (REGULATION OF AGE OF
SUPERANNUATION) ACT, 1984.

Whereas, the age of superannuation of Government employees has been prescribed as 55 years vide the Andhra Pradesh Public
Employment (Regulation of Age of Superannuation) Act, 1984. For the
Last Grade Service employees, the age of superannuation has been fixed as 60 years.
And whereas, the Principal Act has been further amended during the year 2014 enhancing the age of superannuation from 58 years to60 years to the State Government employees etc., w.e.f 02.06.2014 vide the Andhra Pradesh Public Employment (Regulation of Age of
Superannuation) (Amendment) Act, 2014 (Act No.4 of 2014);

And whereas, there has been significant improvement in the average life expectancy compared to that in 2014. As per the world
Health Organization, the global average life expectancy in 2019 around 73 years and the average Indian lived up to 70 years. There
has been improved health conditions in general also;

And whereas, it is considered that in order to utilize the experience and expertise of the senior employees and considering the increased life expectancy and improved health conditions in
general, proposed to enhance the current age of superannuation of 60 years to 62 years to all the State Government employees covered under the Andhra Pradesh Public Employment (Regulation of Age of Superannuation) Act, 1984 and to give effect to the decision from 01.01.2022. In order to give effect to the above, it is necessaiy to
promulgate an ordinance. And whereas, section 2 of the Ordinance seeks to give effect
to the above decision.

And whereas, section 3 of the Ordinance is necessitated as consequence to the amendment of the Clause 3A(2) by the State of Telangana in the 1984 Act (in application to Telangana) by Act No.3 of 2021 which came into force w.e.f. 30.03.2021.

And whereas, the subject matter needs immediate action in view of the fact that if necessary amendments to the Statute are not immediately affected, the tenure and the retirement dates of the serving public servants would be affected. In view of the existing conditions arising from the upsurge of covid in the immediate past, and the
legislature of the State is not in session, the above stated circumstances require immediate action.

And whereas, the Legislature of the State is not now in session and the Governor of the Andhra Pradesh is satisfied that circumstances exist which render if necessary for him to take
immediate action.

Now, therefore, in exercise of the powers conferred by the Clause
(1) of Article 213 of the Constitution of India, the Governor hereby
promulgates the following Ordinance;
