ORDER:

The following notification shall be published in an extra-ordinary issue of the Telangana Gazette, dated: 28.01.2025:-

NOTIFICATION

In exercise of the powers conferred by section 32 of the Right of Persons with Disabilities Act, 2016(Central Act No.49 of 2016) and in compliance with the directions of the Hon'ble Supreme Court of India in W.P.(Civil) No.292 of 2006, dated: 15.12.2017, in Disabled Rights Group & Anr. Vs Union of India & Others, the Governor of Telangana hereby notifies the following:-

1) All Government Institutions of higher education and other higher education institutions receiving aid from the Government shall reserve not less than five percent for persons with benchmark disabilities.

2) The persons with benchmark disabilities shall be given an upper age relaxation of five years for admission in institutions of higher education.

3) As defined under clause (r) of section 2 of the Right of Persons with Disabilities Act, 2016, (Central Act No.49 of 2016) "Persons with benchmark disability" means a person with not less than forty percent of a specified disability where specified disability has not been defined in measurable terms and includes a person with disability where specified disability has been defined in measurable terms as certified by the certifying authority.

4) As per clause (zc) of section 2 of the said Act, "specified disability" means the disabilities as specified in the schedule of the Act.

5) The "Specified learning disabilities" has been specified in the Schedule of the Act.

6) To apportion the reservation for each category of disability at the rate of 1% each to the following categories:-

a) Blindness and low vision;

b) Deaf and hard of hearing;

c) Locomotor disability including cerebral palsy, leprosy cured, dwarfism, acid attack victims and muscular dystrophy;
